RELEASE AND WAIVER RELEASE OF AND WAIVER FROM LIABILITY FORM – DOG DAZE LEISURE SPORTS LEAGUES THIS RELEASE OF AND WAIVER OF LIABILITY FORM (“Release”) is executed by the “Participant” signed below in favor of The Day of Games, LLC, its members, officers, employees, and independent contractors (collectively “DOG”). The Participant desires to partake in the DOG Daze Leisure Sports League games and engage in the activities related to being a Participant (“Activities”). The Participant understands that the Activities may include potentially dangerous and hazardous activities including but not limited to the playing of games with heavy objects and the playing of games that may be strenuous. The Participant hereby freely, voluntarily, without duress and with knowledge of the potential risks executes this Release under the following terms: 1. Release and Waiver. Participant does hereby release and forever discharge and hold harmless DOG and its successors and assignees from any and all liability whether caused by negligence of the DOG, the Participant or otherwise for any claim, judgment, loss, liability, cost and expenses (including, without limitations, attorney's fees and costs) arising out of or connected with the Activities. This Release includes but is not limited to any claim arising out of or connected with any illness or injury (minimal, serious, catastrophic and / or death) that Participant may incur or sustain during the Activities, all events associated with the Activities and while traveling to and from the site for the Activity whether or not the Activity actually occurs. Participant further expressly agrees to indemnify and hold harmless DOG for any claims, judgments, losses, liability, cost and expenses brought against DOG by the Participant’s heirs, successors, assignees, executors and administrators. Finally, Participant agrees to reimburse and to make good to the DOG any loss or costs DOG may have to pay as a result of any such action, claim or demand. Participant understands that this Release discharges DOG from any liability or claim that the Participant may have against DOG with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Participant’s Activities with DOG whether caused by the negligence of DOG or its officers, directors, employees, or agents or otherwise. Participant also understands that DOG does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness. 2. Age Limitation. Participant must be 21 years old as of the date of the first event. 3. Release From Medical Treatment. Participant does hereby release and forever discharge DOG from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with the Participant’s Activities with DOG or with the decision by any representative or agent of DOG to exercise the power to give or authorize medical or dental treatment. 4. Assumption of Risk. Participant understands that the Activities include games that may be hazardous (that is, that can cause serious physical injury or death) to the Participant, including, but not limited to, throwing heavy objects, getting hit by thrown objects, strenuous activity, swinging golf clubs, throwing darts, running on the beach, using DOG provided materials and games, and other DOG Daze events. Participant agrees to play with full knowledge of the dangers and potential injuries involved. Participant hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases DOG from all liability for injury, illness, death, or property damage resulting from the Activities and/or Participant’s negligence. Participant also agrees to indemnify DOG for any injury they cause another. The ocean is off-limits and has nothing to do with DOG Daze Activities. 5. Insurance. Participant understands that, except as otherwise agreed to by DOG in writing; DOG does not carry or maintain health, medical, workers compensation, or disability insurance coverage for any Participant. Each Participant is obligated to obtain his or her own medical or health insurance coverage before participating in the Activities. 6. Photographic Release. Participant does hereby grant and convey unto DOG all right, title, and interest in any and all photographic images and video or audio recordings made by DOG during the Participant’s Activities with DOG including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings. 7. Other. Participant expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California (and States specifically where the leagues are being held) and that this Release shall by governed by and interpreted in accordance with the laws of the State of California. Participant agrees that in the event that any clause or provision of this Release shall by held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. All disputes shall be handled by a third party mediator within the State of California, paid for by the Participant. 8. Knowing and Voluntary Execution. Participant declares that he/she has read each and every provision of this Release and fully understands the meaning and importance of its contents. Participant acknowledges that this Release is a binding contract between the DOG and the Participant and that under this Release is releasing the DOG from all liability for claims he/she may have against the DOG. The Participant declares and represents that he/she is at least 21 years of age, has full legal capacity to be bound by this Release and is signing this contract of his/her own free will and accord. 9. Participant shall obey all municipal, state and federal law. 10. No drinking alchohol while participating in DogDaze games. The DogDaze event ends after the games. 11. Events are subject to weather and re-scheduling may occur. Best efforts will be made to accomodate as many people as possible regarding the new date and time. 12. Purchasing the entry fee online and checking the box below acknowledges that you have read the Release. This is the equivalent of having "signed" this document and Participant agrees with the Release in its entirety. Checking the box on this website regarding the Release is the equivalent of the Participant Knowing and Voluntarily Executing this Release. Any reference to "signed" or "signature" or "sign" can also be completed by the Participant by checking the box on the product page which acknowledges that the Participant has read the Release/Waiver and has thereby executed the Release and Waiver.
